Terms of service

Last updated

These terms are the agreement between you and Severi Reivinen, in Finland, who provides Kaavit (“we”, “us”). By creating an account, or by using a board someone has shared with you, you accept them. If you use Kaavit for an organisation, you accept them for that organisation too, and confirm that you may.

The service

Kaavit is a collaborative whiteboard: boards that several people edit at once, with sharing, comments and AI features. It is offered free of charge on the Free plan and, for a monthly price, on the Team plan. What each plan includes is published on the plans page, and the section on paid plans below applies to Team.

We may change, add or remove features and limits. If a change takes away something you rely on, we tell you in advance by email where we can.

Your account

  • You must be at least 16 years old.
  • Give your real name and an email address you can receive mail at, and keep your sign-in details to yourself — your password, and the Google or GitHub account you sign in with. You are responsible for what happens under your account.
  • One account is for one person. Do not create accounts to get around a limit.

Your content

What you put on Kaavit stays yours. You give us the permission we need to store it, show it to the people you share it with, and process it to provide the service, including sending it to an AI provider when you ask for an AI result. That permission ends when the content is deleted, apart from copies in backups until they expire.

You are responsible for your content and for having the right to share it. When you share a board by link, anyone who has the link can open it with the access you chose, until you revoke the link.

AI features

AI results are generated by a model and may be wrong, incomplete or similar to other people’s results. Check them before relying on them. You may use what the AI produces for you, subject to these terms.

AI credits have no money value. They cannot be sold, transferred or exchanged, and are not refunded except as the section on paid plans says. The Free plan’s credits are a trial given once to each organisation. A paid plan’s credits are given for each billing period, are shared by the organisation, and can be used until a day after that period ends; what is left then does not carry over. An organisation on a paid plan can also buy extra credits, described below.

This section applies when an organisation buys a paid plan, or extra AI credits. Only an owner of the organisation can buy either, and they buy it for the organisation.

Who sells it. Paid plans are sold through Link, Stripe’s payment service, which acts as the seller (the merchant of record). You pay Link, and Link handles the payment, VAT or sales tax, receipts and invoices, refunds of the payment and questions about a charge, under Link’s own terms. Your card statement shows the charge from Link. We provide the service you are paying for, under these terms.

Where it is sold. Paid plans are sold only to customers whose billing address is in a country where Link handles VAT or sales tax for the sale. Those countries are listed on Stripe’s page for Managed Payments. If a paid plan is bought from anywhere else, we may cancel it and have the payment refunded.

Price and seats. The price is on the plans page, per member of the organisation per month, with VAT or sales tax added where it applies. The first payment is taken when you buy, for the number of members the organisation has then. When a member joins or leaves, we change the number of seats to match, and the difference for the rest of the month is added to or taken off the next invoice. Guests and people with a share link are not members and are not charged for.

Renewal and cancelling. The plan renews every month and is charged at the start of each month until it is cancelled. An owner can cancel at any time in the organisation’s billing settings. A cancelled plan stays active until the end of the month already paid for, and the rest of that month is not refunded unless the law or Link’s terms require it. If you are a consumer, you keep any right the law gives you to withdraw from the purchase; in the EU that is 14 days, asked for from Link’s support as a refund.

When a payment fails. Link tries the payment again for about a week, and the plan stays active while it does. If it still fails, the plan ends. When a paid plan ends for any reason, the organisation is back on the Free plan: nothing is deleted and every board stays readable and editable, but creating more than the Free plan allows is refused, and AI stops once the credits already given run out.

Extra AI credits. An owner of an organisation on a paid plan can buy extra AI credits for it, for a one-time payment, sold through Link as the plan is and in the same countries. They are shared by the organisation and used once the plan’s credits for the billing period have run out. They can be used for twelve months from the purchase, and stay with the organisation if its paid plan ends; what is left after twelve months is not refunded. They are not refunded otherwise either, unless the law or Link’s terms require it. If you are a consumer, you keep any right the law gives you to withdraw from the purchase, asked for from Link’s support as a refund. If the payment is refunded or disputed, the credits it bought end, and those already used stay used.

Changing the price. We tell the organisation’s owners by email at least 30 days before a price change, and it applies from the first renewal after that. If you do not accept it, cancel before then.

Deleting an organisation. An organisation with a plan that is still going to renew cannot be deleted. Cancel the plan first.

Acceptable use

Do not use Kaavit to:

  • store or share anything illegal, including child sexual abuse material, content that infringes someone’s rights, or content that incites violence or hatred;
  • harass, threaten or impersonate anyone, or send unwanted invitations;
  • distribute malware or phishing, or collect other people’s data without their consent;
  • probe, overload or break into the service, guess share links, or get around a limit, a rate limit or an access control;
  • generate content with the AI features that is illegal or that its providers’ usage policies forbid.

Report content that breaks these rules to abuse@kaavit.com, or with “Report this board” on the board itself. Say which board it is and what is wrong with it.

We may suspend a board, an organisation or an account that breaks these rules. A suspended board or organisation cannot be opened by anyone, and a suspended account cannot sign in. A suspension deletes nothing: when we lift it, everything is back as it was. We email the reason to the organisation’s owners, or to the account holder. To appeal, write to abuse@kaavit.com.

Ending the agreement

You can stop at any time by deleting your account in your account settings. If you are the owner of an organisation with a paid plan, cancel the plan first. We may end it by giving you 30 days’ notice by email, or at once if you seriously or repeatedly break these terms. When the agreement ends, your data is deleted as described in the privacy policy.

No warranty

Kaavit is provided as it is. We work to keep it available and your data safe, but we do not promise that it will always be available, free of errors or never lose data. Keep your own copy of anything you cannot afford to lose; a board can be exported as an image. If you are a consumer, this does not limit what the law says a service you pay for must be.

Liability

We are not liable for indirect or consequential losses, such as lost profits, lost data or business interruption. Our total liability to you is limited to the greater of 100 euros and what was paid for the service in the 12 months before the claim. None of this limits liability that the law does not allow to be limited, such as for damage caused intentionally or by gross negligence, or your rights as a consumer.

Changes to these terms

When we change these terms we update the date at the top. If a change affects your rights, we tell you by email at least 30 days before it takes effect. Continuing to use Kaavit after that means you accept the new terms; if you do not, you can delete your account.

Law and disputes

These terms are governed by the laws of Finland. If you are a consumer, you keep the protection of the mandatory laws of the country you live in, and you can take a dispute to the Finnish Consumer Disputes Board or to a court where you live. Otherwise disputes are settled in the courts of Finland.
